User Agreement
The deal between you and WhiMate. Plain English, but it's binding.
Effective June 2026
The short version
WhiMate is for meeting people in real life. The whole thing rests on three promises:
- Be nice to strangers.
- Show up when you say you will.
- If someone's a creep, report them.
The sections below are the full agreement. By creating an account or using WhiMate, you accept all of it. If you don't agree, don't use the app.
1. Who can use it
You must be 18 or older and legally able to enter this agreement. You confirm your age when you sign up. WhiMate is strictly 18+ β there is no version for minors. We rely on your honesty; lying about your age is itself a breach of this agreement and grounds for removal.
You also agree to give accurate information about yourself and to keep it up to date.
2. Your account
Your account is yours alone β one real person, not shared, not sold, not transferred. You're responsible for what happens under it. Keep your sign-in secure, and tell us at hello@whimate.com if you think someone else got in.
3. Location is part of the deal
WhiMate runs on real proximity. To post, join, or respond to activities you must turn on location, and you grant us permission to use your device location to power distance, the map, and discovery. Other users never see your exact coordinates β only an approximate distance. How we handle location is described in our Privacy Policy.
4. What you can post
You're responsible for everything you add β your name, photos, Instagram handle, activity ideas, captions, and messages. Don't post or send anything that is:
- illegal, or that encourages illegal acts;
- hateful, harassing, threatening, or bullying;
- sexually explicit, or sexual content involving minors of any kind;
- spam, scams, advertising, or solicitation;
- someone else's private info, or content you don't have the right to share;
- impersonating another person or WhiMate itself.
Don't scrape, hack, overload, or reverse-engineer the app, or use bots to interact with it.
5. Your content stays yours
You keep ownership of what you post. To run the service, you grant WhiMatea limited, worldwide, royalty-free license to store, display, and share your content with the people it's meant for (for example, showing a hangout photo to the crew or to the specific people you picked). This license ends when you delete the content or your account, except for copies others already saw or that we must keep for legal reasons.
You promise you have the right to post what you post, and that it doesn't break the rules above.
6. Photos & shared albums
When you add photos to a hangout, you choose who sees them (the whole crew or specific people) and how long they last. Even so, anyone who can see a photo could screenshot or copy it β so only share what you're comfortable with others having. Don't post photos of people who haven't agreed to be in them. We can remove any photo that breaks these rules.
7. Messages are temporary
Coordination chats are built to disappear β messages clear automatically a short time after sending. WhiMateis for arranging a meet-up, not a record-keeping service, and we don't guarantee any message is stored, backed up, or recoverable. Don't use it for anything you need to keep.
8. Meeting people β your safety, your call
This is the most important part. WhiMate helps you find people; what happens when you meet is between you and them. You meet strangers at your own risk.
- We do not run background checks or verify anyone's identity, criminal history, or intentions.
- Badges (like photo-verified) are light signals, not guarantees about who someone is.
- We can't promise anyone will show up, behave well, or be who they say.
Protect yourself the way you would anywhere online:
- Meet in public the first time (we keep a list at /spots).
- Tell a friend where you'll be β you can share an ETA from the app.
- Trust your gut. If it feels off, leave.
You accept full responsibility for your own conduct and safety, and for your interactions with other people, both online and in person.
9. Moderation & ending access
To keep WhiMate safe we can remove content, hide posts, limit features, suspend, or permanently ban any account β at our discretion, and without prior notice or an explanation. Reporting and blocking tools are built in; serious issues may be referred to the authorities.
You can stop using WhiMate any time and delete your account from your profile, which removes your profile, posts, matches, and messages.
10. Other services we rely on
WhiMatelinks to and uses third parties β for example your Instagram handle (as a trust signal) and our hosting and email providers. We don't control them, and their own terms and privacy policies apply to your use of them.
11. The app is provided βas isβ
We work hard on WhiMate, but we provide it as is and as available, without warranties of any kind β express or implied β including fitness for a particular purpose, reliability, or that it will be uninterrupted, secure, or error-free. You use it at your own discretion and risk.
12. Limits on our liability
To the fullest extent allowed by law, WhiMate and the people who build it are not liablefor any indirect, incidental, or consequential damages, or for anything arising out of your use of the app or your interactions with other users β including anything that happens when you meet someone in person. Where liability can't be excluded, it's limited to the greater of the amount you paid us in the past 12 months (likely zero) or CADΒ $100. Some places don't allow these limits, so parts may not apply to you.
13. You cover claims you cause
You agree to indemnify and hold WhiMate harmless from claims, losses, or costs (including reasonable legal fees) arising from your content, your use of the app, your conduct toward others, or your breach of this agreement.
14. Governing law
This agreement is governed by the laws of Alberta, Canada, without regard to conflict-of-laws rules, and any dispute will be handled by the courts located there β except where your local consumer-protection law gives you rights that can't be waived.
15. Changes
We may update this agreement. When we do, we'll change the date at the top, and for meaningful changes we'll let you know in the app. Continuing to use WhiMate after a change means you accept the new terms.
